We collect email addresses solely for the purpose of notifying users about updates, providing service notifications, and to request feedback about our services.
Third party accounts
Fotor does not store, nor do we have access to your Facebook, Twitter, and Flickr passwords. Fotor does not have access to private information that has not been made publically available by users on non-Fotor accounts. Users are free to suspend their social website connection with Fotor at any time.
Content and Conduct
Content:
By using the services of Fotor.com, users agree that all content, whether publicly posted or privately transmitted, is the sole responsibility of the person who has generated, transmitted, shared or posted the content. This means that users, and not Fotor, are entirely responsible for all content and at every stage. This includes editing, uploading, posting, sharing, emailing or otherwise transmitting or making available content via any of the services provided. Fotor does not guarantee the storage of content and is not intended as a back-up solution. Users should back-up all content. Fotor is not responsible for content that is lost or damaged.
By using Fotor.com, users agree that it is prohibited to edit, upload, post, share, email or otherwise transmit or make available any of the following:
Content that is unlawful, abusive, obscene, pornographic, profane, harmful, threatening, abusive, harassing, vulgar, defamatory, libelous, invasive of another's privacy, or hateful racially or ethnically.
Content that you do not have a right to edit, upload, post, share, email or otherwise transmit or make available according to any law, or due to contractual or fiduciary relationships. This includes inside information or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements.
Content that could infringe copyright laws or other proprietary or intellectual property rights without the explicit permission of the owner and the persons (or their parents or legal guardians, where applicable) who are shown in the content, if applicable.
Any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
Unsolicited or unauthorized advertising, promotional materials, "junk mail, " "spam, " "chain letters," "pyramid schemes, " or any other similar forms of solicitation.
Conduct:
We expect users to use the services provided by Fotor.com in a lawful and respectful manner. In particular, by using our services users agree to not partake in the following:
Harass, "stalk" or otherwise harm others, or violate any laws that protect minors in any way.
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity, including forging headers or otherwise manipulating identifiers in order to disguise the origin of content.
Download content posted by another user that you know, or reasonably should know in a manner that is not lawful.
Advertise or offer to sell or buy any goods or services for any business purpose, unless Fotor explicitly allows such messages.
Interfere with or disrupt the Service or servers or networks connected to Fotor.com, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
Facilitate the sale or use of narcotics, steroids, prescription drugs and devices, tobacco products, certain controlled substances or other products or practices that present a risk to consumer safety.
Facilitate activities involving the use of ammunition, firearms, knives, or other weapons that are regulated under applicable laws.
Facilitate activities involving gambling, sports betting, horse or greyhound racing, or any other activity that indirectly supports gambling.
Violate any code of conduct or other guidelines which may be applicable for any particular area of the Service, including any applicable local, state, national or international laws, or other regulations with jurisdiction.
Rights to Content
Content Available on the Service:
You understand that by using the services of Fotor.com, you may be exposed to content that is offensive, indecent or objectionable, content that promotes activities or practices that pose a risk to your health or that are otherwise illegal or objectionable. Fotor is not liable in any way for user content, or for loss or damage of any kind, including bodily injury and death, that may be incurred as a result of the using our services.
You acknowledge that Fotor does not pre-screen content, but that Fotor and its designees shall have the right (but not the obligation) at their discretion to refuse, remove or move any content, either permanently or temporarily that violates our codes of conduct or regulations concerning content. Users agree to evaluate and bear all risks associated with the use of any services provided by Fotor.com and are responsible for any content they have edited, uploaded, posted, shared, emailed or otherwise transmitted or made available via any of the services provided, including the safety and accuracy of such content.
Fotor does not claim ownership of the content you edit, upload, post, share, email or otherwise transmit or make available via the services we provide. In addition, with respect to photos that you edit using the Service, the photos remain on your local computer and are not uploaded to the Service in most cases. However, in those instances where you upload, post, share, email or otherwise transmit or make available content, you hereby grant Fotor a nonexclusive, worldwide, royalty free, non-revocable, sublicensable license to use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat such content for the purpose of promoting Fotor.com, or for other functions that may help to improve the services we provide. Other than as permitted or requested by you however, we will not use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate or reformat your photos. In addition, if you upload photos to Fotor.com solely for the purpose of editing, we will use commercially reasonable efforts to delete the copies of such photos stored by the Service within two hours after it is no longer necessary for such photos to be stored. If you share any of your content with, or otherwise make such content available to other users, you hereby grant such users a nonexclusive, worldwide, royalty free, perpetual, non-revocable, sublicensable license to use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat such content.
Copyright Policy:
Fotor respects the intellectual property of others, and we ask our users to do the same. Fotor will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws with respect to any alleged or actual infringement. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide our copyright agent with the following information:
An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
A description of the copyrighted work or other intellectual property that you claim has been infringed.
A description of where the material in question is located, including details that will assist our staff with locating it on a specific place on the website.
Your address, telephone number, and email address.
A statement by you, made under penalty of perjury, that the information provided is accurate, and that you are the copyright or intellectual property owner, or authorized to act on the copyright or intellectual property owner's behalf.
Intellectual Property Rights
You acknowledge and agree that the Service and any related software used in connection with Fotor.com contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Fotor, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the service or the software of Fotor.com, in part or in whole. Software, if any, that is made available to download from the Service, excluding software that may be made available by end-users through the Service, is the copyrighted work of Fotor and/or its suppliers. Your use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software ("License Agreement"). You may not install or use any software that is accompanied by or includes a license agreement unless you first agree to the License Agreement terms. For any Software not accompanied by a License Agreement, Fotor grants you a personal, non-transferable and non-exclusive right and license to use the object code of its Software on a single computer, provided that you shall not (and shall not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code. It is also prohibited to sell, assign, sublicense, or otherwise transfer any rights to the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by Fotor.com for use in accessing the Service. Any rights not expressly granted herein are reserved.
